1. Definitions

• “Pheriwala” refers to the Pheriwala Marketplace Platform.
• “Seller” refers to the seller who sells products on the platform.
• “Customer” refers to the buyer on the platform.

2. Seller Registration

• The Seller shall provide correct and complete KYC documents.
• It is the Seller’s responsibility to keep all information true and updated.
• In case of false information, the account may be suspended or terminated.

3. Product Guidelines

• Only legal and lawfully permitted products may be listed.
• Fake, prohibited, stolen, or copyright-infringing products are strictly not allowed.
• Product description, images, price, and stock must be accurate.

4. Pricing

• The Seller will set the product prices independently.
• The platform may apply commission, fees, or promotional rules from time to time.

5. Orders & Shipping

• The Seller must accept and dispatch orders on time.
• The Seller is responsible for incorrect, damaged, or incomplete deliveries.
• Repeated order cancellations may lead to action against the Seller.

6. Returns, Refunds & Complaints

• The Seller is responsible for timely resolution of customer complaints.
• Returns and refunds will be processed as per platform policy.
• The Seller will be liable in case of wrong product delivery.

7. GST & Taxes

• Where required by law, the Seller must provide valid GSTIN and tax details.
• The Seller is responsible for payment of all applicable taxes.

8. Payments

• Payments will be made as per the platform’s Settlement Policy.
• Refunds, chargebacks, penalties, or other adjustments may be deducted from payouts.

Pheriwala may suspend or block a Seller’s listing, store, or account temporarily or permanently without prior notice in the following cases:

• Fake, illegal, or prohibited products.
• False information or misleading ads.
• Poor product quality.
• Failure to deliver on time.
• Excessive returns or cancellations.
• Violation of platform policy/Indian law.
• Fraud, fake orders, payment irregularities.
• Any behavior harming the platform’s or customers’ reputation.

Pheriwala’s decision will be final based on available facts and investigation. In serious cases, the Seller’s account may be permanently closed.

11. Penalty

In case of violation of rules, Pheriwala may take action such as warning, monetary penalty, payment hold, listing removal, or account termination.

12. Intellectual Property

The Seller must ensure that its products, images, logos, and content do not violate any third-party rights.

13. Privacy

The Seller shall not misuse customer personal data and must comply with applicable data protection laws.

14. Limitation of Liability

Pheriwala is only a marketplace platform. The Seller is solely responsible for product quality, warranty, safety, and legality.

15. Policy Amendments

Pheriwala may modify these Terms & Conditions at any time. Updated terms will be effective upon publication.

16. Governing Law

These terms are governed by the laws of India. In case of disputes, the jurisdiction of competent courts shall apply.
